# FieldMarx Ambassador Program Terms
**Effective date:** July 12, 2026
These FieldMarx Ambassador Program Terms constitute a legally binding agreement between Zap Media, LLC, doing business as FieldMarx (“FieldMarx,” “we,” “us,” or “our”), and the individual or entity accepted into the FieldMarx Ambassador Program (“Ambassador,” “you,” or “your”).
By submitting an application, electronically accepting these Terms, or participating in the FieldMarx Ambassador Program, you acknowledge that you have read, understood, and agreed to these Terms.
Submitting an application does not guarantee acceptance. These Terms become effective between you and FieldMarx only when FieldMarx approves your application or otherwise confirms your participation in writing.
## 1. Program Purpose
The FieldMarx Ambassador Program allows approved participants to promote FieldMarx, refer eligible users, and potentially earn fixed commissions when qualifying referred users become paying FieldMarx subscribers.
Participation is nonexclusive. FieldMarx may work with other ambassadors, affiliates, sponsors, clubs, organizations, creators, trainers, handlers, or businesses, including those operating in the same geographic area or market.
## 2. Eligibility
To participate, you must:
1. Be at least 18 years old;
2. Have the legal capacity to enter into a binding agreement;
3. Provide accurate and complete application, contact, payment, and tax information;
4. Maintain a FieldMarx account in good standing when required;
5. Comply with these Terms and all applicable laws, regulations, platform rules, and advertising requirements; and
6. Receive written approval from FieldMarx.
You must promptly update FieldMarx if any information submitted during your application changes.
FieldMarx may approve or decline any applicant in its sole discretion, subject to applicable law. FieldMarx is not required to provide a reason for its decision.
## 3. Ambassador Levels
FieldMarx may assign an Ambassador to one of the following levels:
* FieldMarx Ambassador
* FieldMarx Pro Ambassador
* FieldMarx Elite Ambassador
Ambassador levels may have different commission amounts, eligibility requirements, account benefits, merchandise benefits, promotional opportunities, or other program features.
FieldMarx determines level placement and advancement based on factors that may include:
* Number of qualified referrals
* Number of validated paid conversions
* Account and payment standing
* Program activity
* Professional conduct
* Quality of referrals
* Compliance history
* Community involvement
* Continued alignment with FieldMarx
Reaching a specific referral or conversion total does not guarantee advancement unless FieldMarx expressly states otherwise in writing.
FieldMarx may promote, maintain, or demote an Ambassador’s level in accordance with these Terms.
## 4. Referral Codes and Links
FieldMarx may issue you:
* A personalized referral or promotional code;
* A personalized referral URL;
* An ambassador profile, handle, or landing page; or
* Access to approved marketing materials.
All referral codes, links, handles, landing pages, dashboards, and related program tools remain the property of FieldMarx.
You may not:
1. Sell, transfer, sublicense, or assign your referral code;
2. Allow another person or organization to represent the code as its own;
3. modify, conceal, manipulate, or interfere with referral tracking;
4. Create or use accounts to generate self-referrals;
5. Redeem your code for your own account unless FieldMarx expressly authorizes it;
6. Encourage users to create duplicate or false accounts;
7. Offer unauthorized rewards, rebates, cash payments, or incentives for using your code;
8. Publish your code on coupon, discount, deal, cashback, or code-aggregation websites without written permission;
9. Use automated messages, bots, scripts, or unsolicited bulk communications to distribute your code; or
10. Represent that your code provides a benefit other than the benefit currently authorized by FieldMarx.
FieldMarx may modify, replace, suspend, or revoke any referral code, link, handle, or landing page at any time when necessary to protect the program, address misuse, resolve technical issues, or maintain brand consistency.
## 5. Referral Attribution
Unless FieldMarx states otherwise, referral attribution is based on the first valid Ambassador referral code successfully associated with the referred user.
A user will generally remain attributed to the first qualifying Ambassador code that the user redeems. Entering or clicking another Ambassador’s code or link afterward does not ordinarily change attribution.
FieldMarx’s records will control for purposes of determining attribution, eligibility, commissions, and payouts.
Referral tracking may depend on:
* Successful code redemption;
* Account creation or account identification;
* Browser, device, or application tracking;
* Subscription and transaction records;
* FieldMarx database records; and
* Fraud and eligibility reviews.
FieldMarx does not guarantee that every click, visit, conversation, download, account, or purchase will be successfully tracked.
A referral is not qualified merely because a person clicked a link, downloaded FieldMarx, created an account, entered a code, or began a trial.
## 6. Referred-User Benefit
An eligible user who successfully redeems a valid Ambassador code may receive 30 days of FieldMarx Pro access.
The benefit is subject to eligibility requirements established by FieldMarx. FieldMarx may deny, reverse, or revoke the benefit when it determines that:
* The user is not eligible;
* The user previously redeemed the same or a substantially similar promotion;
* The account is duplicate, false, automated, or fraudulent;
* The code was misused;
* The Ambassador offered unauthorized terms;
* The redemption resulted from self-referral or coordinated abuse;
* A technical or administrative error occurred; or
* Providing the benefit would violate applicable platform, billing, or legal requirements.
Unless FieldMarx expressly states otherwise, referral benefits:
* Have no cash value;
* Cannot be sold or transferred;
* Cannot be combined with another referral code;
* May not be extended or replaced;
* Do not guarantee access to every future FieldMarx feature; and
* May be changed prospectively for future referrals.
FieldMarx may support qualifying win-back referrals for certain former users. Eligibility for a win-back benefit is determined exclusively by FieldMarx’s systems and policies.
## 7. Qualified Conversions
A “Qualified Conversion” occurs only when all applicable conditions are satisfied, including:
1. The referred user was validly attributed to you;
2. The user was eligible for the referral program;
3. The user purchases an eligible paid FieldMarx subscription;
4. The payment is successfully collected;
5. The transaction is not canceled, refunded, disputed, reversed, or charged back during the applicable maturity period;
6. The referral and transaction comply with these Terms;
7. The referral is not fraudulent, duplicated, manipulated, or self-generated; and
8. Any additional qualification requirements shown in your dashboard or communicated by FieldMarx are satisfied.
A trial start, account registration, app installation, referral-code redemption, payment authorization, failed payment, complimentary subscription, administrative access grant, discounted internal account, or other nonqualifying transaction does not constitute a Qualified Conversion.
When a user subscribes before the end of the user’s promotional access period, FieldMarx may treat the conversion as occurring when payment is successfully collected rather than requiring the user to complete the entire promotional period.
## 8. Commissions
You may earn a fixed commission for each Qualified Conversion.
Commission amounts are not calculated as a percentage of subscription revenue unless FieldMarx expressly states otherwise in writing.
Your applicable commission amount will be displayed in one or more of the following:
* Your ambassador approval notice;
* Your ambassador dashboard;
* A commission schedule provided by FieldMarx; or
* A written amendment or campaign offer.
Commission amounts may differ based on:
* Ambassador level;
* Subscription plan;
* Campaign;
* Geographic market;
* Product or service;
* Customer eligibility;
* Promotional period; or
* Other program criteria.
FieldMarx may change commission amounts prospectively. Unless necessary to address misuse, legal compliance, fraud, or a clear error, a commission change will not reduce a valid commission already earned under the commission schedule in effect at the time of the Qualified Conversion.
A commission shown as pending, estimated, processing, unmatured, or under review has not yet become payable.
## 9. Commission Maturity and Validation
Commissions are subject to a validation and maturity period established by FieldMarx.
During this period, FieldMarx may confirm:
* Successful payment;
* Subscription status;
* Referral attribution;
* User eligibility;
* Refund or chargeback activity;
* Compliance with these Terms;
* Whether the transaction is genuine; and
* Whether the referral resulted from prohibited conduct.
The applicable maturity period may be shown in your dashboard or commission schedule. Unless another period is displayed, commissions mature 45 days after the qualifying payment is successfully collected.
FieldMarx may extend the review period when reasonably necessary to investigate suspected fraud, a payment dispute, an attribution dispute, technical issues, program abuse, or a violation of these Terms.
## 10. Reversals and Adjustments
FieldMarx may deny, cancel, withhold, offset, or reverse a commission when:
* A subscription payment fails;
* A payment is refunded, reversed, or charged back;
* The user disputes the transaction;
* The subscription or account was created fraudulently;
* The referral was self-generated or coordinated;
* The referred user was ineligible;
* Attribution resulted from an error;
* The commission was calculated incorrectly;
* The Ambassador violated these Terms;
* The Ambassador made false or misleading claims;
* The Ambassador used prohibited promotional methods; or
* The transaction was otherwise not a Qualified Conversion.
If a commission has already been paid, FieldMarx may deduct the amount from future commissions or request repayment.
FieldMarx may correct clerical, technical, tracking, or calculation errors.
## 11. Payouts
Matured commissions become eligible for payout when your payable balance reaches at least $25.
Balances below $25 may roll forward until the threshold is reached.
FieldMarx currently processes payouts manually and may establish a regular or periodic payout schedule. A commission becoming eligible does not guarantee immediate payment on a particular date.
Before issuing payment, FieldMarx may require:
* A valid payment method;
* Identity verification;
* A completed Form W-9, Form W-8, or other applicable tax documentation;
* Confirmation of your legal name and address;
* Resolution of suspected fraud or compliance issues; and
* Any other information reasonably necessary to process the payment lawfully.
You are responsible for ensuring that your payment information is accurate.
FieldMarx is not responsible for delays, fees, failed payments, or lost payments resulting from incorrect information supplied by you, payment-provider limitations, legal restrictions, or circumstances outside FieldMarx’s reasonable control.
FieldMarx may apply reasonable third-party payment-processing fees when those fees are disclosed before payment.
## 12. Taxes
You are solely responsible for determining and paying all federal, state, local, and other taxes arising from commissions, merchandise, complimentary access, incentives, or other benefits you receive through the program.
FieldMarx may report payments or benefits to tax authorities when required by law.
You agree to provide accurate tax documentation upon request. FieldMarx may withhold payouts until required documentation is received and verified.
Nothing in these Terms constitutes tax advice.
## 13. Required Advertising Disclosures
Your relationship with FieldMarx may constitute a material connection that must be disclosed when you endorse, recommend, review, feature, or promote FieldMarx.
You must make disclosures that are clear, conspicuous, difficult to miss, and presented with the endorsement itself.
Depending on the platform and context, acceptable disclosures may include:
* “FieldMarx Ambassador”
* “I’m a FieldMarx Ambassador and may earn a commission.”
* “Paid FieldMarx Ambassador”
* “Sponsored by FieldMarx”
* “Ad”
* “Advertisement”
* “I receive benefits from FieldMarx when people use my referral code.”
A disclosure must accurately describe your relationship with FieldMarx.
You may not rely exclusively on:
* A disclosure hidden in your profile or biography;
* A disclosure placed after a “more” or “see more” break;
* A disclosure buried among hashtags;
* A vague phrase such as “partner,” “collab,” “supporter,” “thanks,” or “ambassador” when the financial or benefit relationship would not otherwise be clear;
* A platform disclosure tool when that tool does not make the relationship sufficiently clear;
* A disclosure appearing only at the end of a video;
* A disclosure that viewers are unlikely to see, hear, read, or understand; or
* A disclosure contained only on a separate webpage.
For photographs, stories, reels, short-form video, livestreams, podcasts, and other visual or audio content, the disclosure must be presented in a manner appropriate to the format.
For livestreams or lengthy content, disclosures should be repeated when reasonably necessary so viewers who join later can understand the relationship.
You are responsible for complying with all applicable Federal Trade Commission requirements, state laws, platform policies, and other advertising rules.
FieldMarx may provide disclosure guidance, examples, or approved language, but you remain independently responsible for making appropriate disclosures.
## 14. Truthful Statements and Endorsements
All statements you make concerning FieldMarx must:
1. Reflect your honest opinions, findings, beliefs, and experiences;
2. Be truthful and not misleading;
3. Be based on your actual experience when described as personal experience;
4. Accurately describe the app’s current features, pricing, availability, and benefits;
5. Avoid unsupported performance or outcome claims; and
6. Clearly disclose material limitations when necessary to prevent a statement from being misleading.
You may not state or imply that:
* FieldMarx guarantees better dog performance;
* FieldMarx guarantees passing scores, placements, titles, or awards;
* FieldMarx replaces professional training judgment;
* Every feature is available on every platform or account unless accurate;
* You are an employee, owner, officer, agent, spokesperson, or authorized representative of FieldMarx;
* FieldMarx officially endorses a kennel, trainer, club, product, political position, organization, event, or other business unless approved in writing;
* A personal opinion is an official FieldMarx position; or
* Your referral offer provides benefits beyond those authorized by FieldMarx.
You must promptly correct or remove inaccurate claims after becoming aware of the issue or after receiving a request from FieldMarx.
## 15. Prohibited Promotional Conduct
You may not promote FieldMarx through:
* False, deceptive, misleading, defamatory, or unsubstantiated claims;
* Unsolicited bulk email, text messages, direct messages, comments, or other spam;
* Automated posting, bot activity, or fake engagement;
* Purchased followers, fabricated traffic, or manipulated analytics;
* False reviews, testimonials, ratings, or endorsements;
* Reviews or testimonials conditioned on expressing a positive opinion;
* Impersonation of FieldMarx or another person;
* Trademark bidding or paid-search advertising using “FieldMarx” or confusingly similar terms without written permission;
* Domain names, usernames, pages, groups, or accounts that misleadingly appear to be operated by FieldMarx;
* Coupon, rebate, deal, cashback, or referral-code aggregation services without written permission;
* Misleading redirects, forced clicks, cookie stuffing, hidden links, adware, spyware, or similar tracking manipulation;
* Content that is unlawful, threatening, abusive, discriminatory, sexually explicit, hateful, or materially harmful to FieldMarx’s reputation;
* Promotion associated with illegal activity;
* Claims that disparage competitors through false or misleading statements;
* Unauthorized contests, giveaways, sweepstakes, or promotions involving FieldMarx; or
* Any conduct that violates platform rules or applicable law.
## 16. Reviews and Testimonials
You may provide honest reviews of FieldMarx, including constructive criticism.
FieldMarx will not require you to express a positive opinion as a condition of receiving a commission or program benefit.
However, you may not:
* Create a review from an account that falsely appears independent;
* Hide your relationship with FieldMarx when the relationship may affect how consumers evaluate the review;
* Submit multiple reviews intended to manipulate ratings;
* Request or arrange false reviews;
* Use artificial intelligence, contractors, friends, relatives, or other accounts to create fabricated testimonials;
* Edit another person’s testimonial in a way that materially changes its meaning; or
* Represent atypical results as typical without appropriate context.
## 17. Brand and Intellectual Property
“FieldMarx,” FieldMarx logos, designs, graphics, slogans, screenshots, videos, application interfaces, and other brand materials are owned by or licensed to FieldMarx.
While you remain an approved Ambassador, FieldMarx grants you a limited, revocable, nonexclusive, nontransferable, nonsublicensable license to use approved FieldMarx brand materials solely to promote FieldMarx in compliance with these Terms.
You may not:
* Alter a FieldMarx logo without permission;
* Combine FieldMarx branding with another logo in a manner implying an unauthorized partnership;
* Place FieldMarx branding on merchandise for sale;
* Register FieldMarx branding as a trademark, domain, username, business name, product name, or service name;
* Create materials that appear to be official FieldMarx communications when they are not;
* Sell, license, distribute, or commercially exploit FieldMarx materials; or
* Continue using FieldMarx materials after your participation ends.
FieldMarx may require you to modify or remove branded materials that are inaccurate, outdated, noncompliant, misleading, or inconsistent with brand standards.
Any goodwill arising from your permitted use of FieldMarx branding benefits FieldMarx.
## 18. Ambassador-Created Content
You retain ownership of original content you create, subject to FieldMarx’s ownership of its preexisting intellectual property.
When you tag FieldMarx, submit content to FieldMarx, use a program-specific submission method, or expressly authorize FieldMarx to reshare content, you grant FieldMarx a nonexclusive, worldwide, royalty-free license to reproduce, display, distribute, repost, and promote that content through FieldMarx-owned websites, applications, emails, and social media channels.
FieldMarx will not use your likeness in paid advertising outside ordinary reposting, organic promotion, or program recognition without obtaining additional permission, unless a separate campaign agreement states otherwise.
You represent that:
* You created the content or have permission to use it;
* The content does not infringe another party’s rights;
* You have obtained any necessary permission from identifiable individuals;
* You have permission to display locations, dogs, training grounds, club materials, music, photographs, and video included in the content; and
* FieldMarx’s authorized use will not violate another agreement.
## 19. Confidential Information
You may receive nonpublic information concerning FieldMarx, including planned features, unpublished designs, campaign information, commission structures, internal performance data, security information, business plans, or other information identified as confidential.
You may not disclose or use confidential information except as necessary to participate in the program.
Confidential information does not include information that:
* Becomes public through no violation by you;
* You lawfully possessed without a confidentiality obligation;
* You independently developed without using confidential information; or
* You lawfully received from a third party without restriction.
You must promptly notify FieldMarx if confidential information is lost, improperly accessed, or disclosed.
## 20. Feedback
You may provide suggestions, ideas, bug reports, feature requests, or other feedback.
You grant FieldMarx a perpetual, irrevocable, worldwide, royalty-free right to use, modify, commercialize, and incorporate that feedback without restriction or compensation.
This provision does not transfer ownership of your independently created promotional content.
## 21. Program Monitoring and Compliance
FieldMarx may reasonably monitor public Ambassador content, referral activity, traffic patterns, conversion activity, code usage, and program-related communications to:
* Verify compliance;
* Evaluate referral quality;
* Detect fraud or abuse;
* Confirm required disclosures;
* Protect users;
* Maintain accurate commission records; and
* Improve the program.
FieldMarx may request screenshots, links, records, explanations, or other information reasonably necessary to investigate a compliance concern.
You agree to cooperate with reasonable compliance requests.
FieldMarx may require correction or removal of noncompliant promotional content. You must act promptly after receiving notice.
## 22. Complimentary Products, Services, and Merchandise
FieldMarx may provide discounted or complimentary subscriptions, merchandise, promotional items, or other benefits.
Such benefits:
* Are provided at FieldMarx’s discretion;
* May depend on your Ambassador level or activity;
* Are not guaranteed;
* May have no cash value;
* May not be exchanged for cash;
* May be subject to availability, sizing, inventory, shipping, and geographic restrictions; and
* May be changed or discontinued prospectively.
Unless authorized in writing, complimentary or discounted items may not be resold.
Receiving a complimentary item does not require you to provide a positive review. Any public endorsement must remain honest and appropriately disclosed.
## 23. Independent Contractor Relationship
You participate as an independent contractor and not as an employee, agent, partner, franchisee, joint venturer, or legal representative of FieldMarx.
You have no authority to:
* Bind FieldMarx to a contract;
* Make commitments on behalf of FieldMarx;
* Incur expenses for FieldMarx;
* Accept payments on behalf of FieldMarx;
* Provide warranties on behalf of FieldMarx;
* Negotiate subscriptions, sponsorships, or partnerships for FieldMarx; or
* Represent that you possess such authority.
You control the manner, location, schedule, and methods through which you lawfully promote FieldMarx, subject to these Terms.
You are responsible for your own equipment, expenses, insurance, licenses, registrations, taxes, and legal obligations.
Nothing in these Terms guarantees any minimum referrals, commissions, work, compensation, access, or duration of participation.
## 24. Expenses
You are responsible for all expenses associated with your participation unless FieldMarx approves a particular expense in writing before it is incurred.
FieldMarx is not obligated to reimburse travel, event entry, internet, equipment, advertising, merchandise, shipping, content-production, or other expenses.
## 25. Program Changes
FieldMarx may modify the program prospectively, including:
* Ambassador levels;
* Qualification standards;
* Referral benefits;
* Commission amounts;
* Eligible subscriptions;
* Maturity periods;
* Payout processes;
* Promotional rules;
* Dashboard functionality; and
* Program benefits.
Material changes to these Terms will be communicated by email, dashboard notice, in-app notice, website posting, or another reasonable method.
Unless a different date is stated, updated Terms become effective when posted or communicated.
Your continued participation after the effective date constitutes acceptance of the updated Terms. When legally required or when FieldMarx determines appropriate, FieldMarx may require renewed electronic acceptance.
Changes will not retroactively eliminate properly matured commissions except when a commission resulted from fraud, abuse, error, refund, reversal, ineligibility, or a violation of these Terms.
## 26. Suspension
FieldMarx may temporarily suspend your code, dashboard, benefits, commission eligibility, or program access while investigating:
* Suspected fraud;
* Unusual referral activity;
* Payment disputes;
* Misleading advertising;
* Missing disclosures;
* Brand misuse;
* User complaints;
* Security concerns;
* Breach of these Terms; or
* Other conduct that may harm users, FieldMarx, or the program.
During suspension, commissions may remain pending until the matter is resolved.
## 27. Term and Termination
These Terms begin upon your acceptance into the program and continue until terminated.
You may leave the program by providing written notice to FieldMarx.
FieldMarx may terminate or remove you from the program:
* At any time upon notice;
* Immediately for fraud, abuse, unlawful conduct, material misrepresentation, brand misuse, harassment, serious reputational harm, or a material breach;
* If you fail to maintain required eligibility;
* If you remain inactive for an extended period;
* If the program is discontinued; or
* For another legitimate business or compliance reason.
Upon termination:
1. You must stop representing yourself as a FieldMarx Ambassador;
2. You must stop using FieldMarx Ambassador branding and program materials;
3. Your referral code and program access may be disabled;
4. Future referrals will not generate commissions;
5. Unmatured commissions may continue through validation unless termination resulted from fraud, abuse, or a material violation;
6. Valid matured commissions remain payable subject to the payout threshold, documentation requirements, offsets, and these Terms; and
7. Provisions that by their nature should survive will remain effective.
FieldMarx may elect to pay a valid final balance below $25 or allow the balance to expire after providing reasonable notice. Any final-payment procedure will be applied consistently with applicable law.
## 28. Records and Disputes
You must notify FieldMarx of a suspected attribution, commission, or payout error within 90 days after the relevant transaction or dashboard entry.
Your notice must include sufficient information for FieldMarx to investigate.
FieldMarx will review disputes in good faith using available account, attribution, payment, referral, and technical records.
Failure to report an issue within 90 days may waive the dispute to the extent permitted by law.
## 29. No Guarantee of Results
FieldMarx does not guarantee:
* Acceptance into the program;
* A particular Ambassador level;
* Referral traffic;
* Successful tracking of every referral;
* User eligibility;
* Paid conversions;
* Any minimum commission;
* Advancement;
* Complimentary products or services;
* Continued availability of the program; or
* Any particular financial result.
## 30. Disclaimer of Warranties
To the fullest extent permitted by law, the program, referral tools, dashboards, links, codes, reports, and materials are provided “as is” and “as available.”
FieldMarx disclaims all express and implied warranties, including warranties of merchantability, fitness for a particular purpose, title, noninfringement, uninterrupted operation, accuracy, and error-free tracking.
Some jurisdictions do not allow certain warranty exclusions, so portions of this section may not apply to you.
## 31. Limitation of Liability
To the fullest extent permitted by law, FieldMarx and its owners, officers, employees, contractors, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, reputational harm, or lost business opportunities arising from or related to the program.
To the fullest extent permitted by law, FieldMarx’s total aggregate liability arising from or relating to the program will not exceed the greater of:
1. The unpaid matured commissions validly owed to you; or
2. The total commissions paid to you during the six months immediately preceding the event giving rise to the claim.
These limitations apply regardless of the legal theory and even if FieldMarx was advised that damages were possible.
Nothing in these Terms limits liability that cannot legally be limited.
## 32. Indemnification
To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless FieldMarx and its owners, officers, employees, contractors, affiliates, and service providers from claims, losses, liabilities, damages, judgments, penalties, costs, and reasonable attorneys’ fees arising from or related to:
* Your promotional activities;
* Your content;
* Your statements, representations, or endorsements;
* Your failure to make required disclosures;
* Your violation of law or platform rules;
* Your infringement of another party’s rights;
* Your misuse of FieldMarx intellectual property;
* Your breach of these Terms; or
* Fraudulent or prohibited referral activity attributable to you.
FieldMarx will provide reasonable notice of an indemnified claim and may control the defense or settlement. You may not settle a claim in a manner that admits wrongdoing by or imposes obligations on FieldMarx without written consent.
## 33. Governing Law
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles.
Subject to any mandatory rights or procedures that cannot legally be waived, the state and federal courts located in Texas will have jurisdiction over disputes arising from these Terms.
Before filing a legal claim, each party agrees to provide written notice describing the dispute and to attempt in good faith to resolve it informally for at least 30 days.
## 34. Notices
FieldMarx may provide notices through:
* The email address associated with your account;
* Your ambassador dashboard;
* The FieldMarx application;
* The FieldMarx website; or
* Another contact method you provided.
You are responsible for maintaining current contact information and reviewing program communications.

## 35. Assignment
You may not transfer or assign your participation, code, commissions, benefits, or rights under these Terms without FieldMarx’s prior written consent.
FieldMarx may assign these Terms in connection with a merger, acquisition, reorganization, asset transfer, financing, change of control, or transfer of the FieldMarx business.
## 36. Severability
If any provision is found invalid or unenforceable, it will be enforced to the maximum extent permitted, and the remaining provisions will remain effective.
## 37. Waiver
A failure to enforce a provision does not waive the right to enforce it later.
Any waiver must be in writing and applies only to the specific circumstance stated.
## 38. Entire Agreement
These Terms, your approved commission schedule, applicable campaign terms, and any written amendment issued by FieldMarx constitute the entire agreement concerning the Ambassador Program.
They replace prior oral or written discussions concerning the same subject.
A separate written campaign, sponsorship, event, or content agreement may supplement these Terms. If a separate agreement expressly conflicts with these Terms, the separate agreement controls only for that specific campaign or arrangement.
## 39. Electronic Acceptance
You consent to the use of electronic records, notices, signatures, and acceptance.
Typing your name, selecting the acceptance checkbox, and submitting your application constitutes your electronic signature.
FieldMarx may retain:
* The accepted version of these Terms;
* Your typed name;
* Your account and application information;
* The acceptance date and time;
* Your IP address;
* Your device or browser information; and
* The version number of the agreement accepted.
You may request a copy of the Terms you accepted.
